Terms & Conditions

1. STATUS AND BUSINESS STRUCTURE 

 

1.1 The Lander School of Performing Arts (“Lander SOPA”, “we”, “our”, “us”) is operated by Emily Lander, a self-employed performing arts teacher.

1.2 All bookings, lessons and services provided through Lander SOPA constitute a direct contract between you (the “student” or “parent/guardian”) and Emily Lander.

1.3 All payments made for lessons, workshops or related services are received by Emily Lander in her capacity as a self-employed practitioner.

1.4 These terms and conditions apply to all bookings and services provided by Lander SOPA. The expressions “you” and “your” refer to the student and/or their parent or legal guardian where applicable.

2. DATA PROTECTION

 

2.1 Lander School of Performing Arts (“Lander SOPA”, “we”, “our”, “us”) is operated by Emily Lander, a self-employed performing arts teacher. Your personal information will be held in strict confidence and processed in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

2.2 Personal data collected through our website, contact forms and booking system (including Calendly) is used solely for the purpose of managing enquiries, bookings, lessons and related services. We do not sell, rent or share your personal data with third parties for marketing purposes.

2.3 By submitting your details through our website or booking platform, you consent to Lander SOPA processing your information for administrative and service-related purposes only.

2.4 Right of Access: You have the right to request a copy of the personal data we hold about you at any time. This will be provided free of charge in an electronic format upon request.

2.5 Right to Erasure: You have the right to request that we erase your personal data where there is no legitimate reason for us to continue processing it. However, we may retain necessary information where required for legal, safeguarding, insurance or financial record-keeping purposes.

3. BOOKING POLICIES AND PAYMENTS

 
3.1 Lessons

3.1.1 All lessons are booked exclusively through the official Lander School of Performing Arts website via our online booking system (Calendly). On occasion, for specific lesson types or formats, the booking option may be customised. These customised lessons will still be booked and paid for via our online booking system (Calendly), but with a personal, one-time-use link.

3.1.2 General Lesson availability is released on a monthly basis. The full schedule for the upcoming month will be published at the end of each preceding month, allowing students and parents to secure their preferred time slots in advance.

3.1.3 The content and focus of each lesson will be tailored to the individual student’s goals, development and ability.

3.1.4 Bookings are confirmed once payment has been received through the designated payment system within the calendly booking system linked in the website.

3.1.5 Lander School of Performing Arts reserves the right to reschedule lessons where necessary. Where possible, a minimum of one week’s notice will be provided and an alternative lesson time will be offered promptly.

3.1.6 If a student or parent/guardian needs to cancel or reschedule a lesson, a minimum of 24 hours’ notice must be provided. Where at least 24 hours’ notice is given, the lesson may be rearranged subject to availability, or refunded to the full cost of the lesson (minus any fees and charges that may have been taken in the booking process)

3.1.7 Lessons cancelled with less than 3 hours’ notice will not be refunded. If a lesson is cancelled between 24 and 3 hours’ of the lesson start time, only half of the lesson cost (minus any fees and charges that may have been taken in the booking process) will be refunded.

3.1.8 Missed lessons without notice will not be refunded. While Lander School of Performing Arts may, at its discretion, offer an alternative time where possible, repeated missed lessons may result in discontinuation of services.

3.1.9 A maximum of three late cancellations or missed lessons within a rolling three-month period may result in the withdrawal of priority booking access or termination of lessons at our discretion.

3.1.10 Lander School of Performing Arts reserves the right to decline or discontinue lessons at its discretion.

3.2 Non-Adult Students (Children)

3.2.1 Lander School of Performing Arts provides lessons for students aged 4–18. For all students under the age of 16, bookings must be made by a parent or legal guardian, who accepts these terms and conditions on the student’s behalf.

3.2.2 For online lessons, a parent or guardian must ensure appropriate supervision within the home environment and remain contactable during the session.

3.2.6 Lander School of Performing Arts is committed to the safety, welfare, and wellbeing of all students. Emily Lander, the principal teacher, holds:

  • a fully enhanced DBS certificate for working with children and vulnerable adults, and
     

  • a Safeguarding Children & Vulnerable Adults qualification

All lessons are conducted in accordance with best safeguarding practices to ensure a safe and professional learning environment.

3.2.7 Lander School of Performing Arts reserves the right to decline or discontinue lessons where appropriate consent or supervision arrangements are not in place.

3.3 Disabilities

3.3.1 Lander School of Performing Arts aims to provide a safe and supportive environment for all students.

3.3.2 For lessons held online, we may be unable to accommodate students with certain disabilities where it is not possible to guarantee digital accessibility or a safe environment. Parents or guardians should contact us prior to booking to discuss any concerns, and we will try our best to accommodate or discuss further.

3.4 Payments, Cancellations, Reschedules & Refunds

3.4.1 All lessons must be booked in advance via the Lander School of Performing Arts website using the online booking system (Calendly). Lessons should be booked at least one week in advance to secure a preferred time slot.

3.4.2 Payments may be made by card or bank transfer in advance of the lesson through the booking system.

3.4.3 Notification of cancellation or reschedule must be made at least 24 hours prior to the scheduled start time of the lesson, only via the booking system. The timestamp on the system will be used to calculate the notice period.

3.4.4 Lessons cancelled or rescheduled with less than 24 hours’ notice, or missed without notice, will be charged at the full lesson rate. Where card details are held, the relevant amount will be debited automatically.

3.4.5 Students are welcome to book lesson times for the entire month in advance. Please note, however, that all lesson times are subject to Lander SOPA’s overall scheduling and availability. On rare occasions, a booked lesson may need to be adjusted; in such instances, Lander SOPA will ensure the lesson is rescheduled at a mutually convenient time. While every effort will be made to maintain preferred time slots, they cannot be guaranteed indefinitely.

3.4.6 Periods of planned absence or unavailability (such as holidays) will be communicated in advance wherever possible, with notice of at least one month. During these periods, online lessons may still be offered, subject to circumstances and mutual agreement.

3.4.7 No refunds will be made for missed lessons, late cancellations (less than 24 hours’ notice), or rescheduled lessons.

3.4.8 Lander School of Performing Arts reserves the right to reschedule lessons if necessary. Where a lesson is rescheduled by Lander SOPA, a mutually agreed alternative time will be offered.

3.4.9 Refunds for unused lessons may be granted at the discretion of Lander SOPA and may incur a small administrative fee.

3.5 Health

3.5.1 Students (or their parent/guardian) must declare any relevant health conditions or concerns to the teacher prior to the commencement of a lesson. By proceeding with the lesson without providing such information, students are deemed to declare that they are in good health and able to participate safely.

3.5.2 The teacher reserves the right to discontinue or postpone a lesson if, in their professional opinion, the student is too young, unfit, or unwell to participate safely.

4. LIMITATION OF LIABILITY

 

4.1 While Lander School of Performing Arts will do its best to provide structured guidance, techniques, and exercises that have been effective for other students, no warranty or guarantee is given that, as a result of lessons, a student will be able to sing at all, or improve their singing ability.

4.2 Lander SOPA does not conduct medical tests or assessments regarding a student’s suitability for singing lessons. Students (or their parent/guardian) agree to participate voluntarily and confirm they are in good health unless otherwise notified.

4.3 While the teacher will endeavour to provide safe exercises and instruction, incorrect technique, misuse of the voice, or practising exercises outside of lessons may cause injury. Students are responsible for immediately informing the teacher if they experience any pain or discomfort during a lesson.

4.4 Students must understand that singing or performing exercises while unwell, particularly with illness affecting the vocal tract or airways, carries an increased risk of injury or vocal damage.

4.5 Lander SOPA, the teacher, or any staff associated with lessons will not be liable for any pain, injury, or vocal damage incurred during lessons or from exercises practiced outside of lessons.

4.6 During the online lessons, students are responsible for their own safety and must take reasonable care at all times.

4.7 In the event that a lesson is cancelled or curtailed by Lander SOPA, liability will be limited to the cost of the affected lesson. Where possible, an alternative lesson will be offered at a mutually convenient time. Lander SOPA shall not be liable for any consequential loss resulting from cancellations.

5. NOTIFICATIONS AND LAW

 

5.1 Lander School of Performing Arts and the teacher shall not be liable, nor be deemed in breach of contract, for any delay in performing or any failure to perform any obligations if such delay or failure is due to causes beyond our reasonable control, including but not limited to acts of God, illness, adverse weather, technical issues, or other force majeure events.

5.2 Any notifications or communications to Lander SOPA must be sent via email to the teacher or the designated bookings email address provided in your booking confirmation. Notifications will be deemed received once an acknowledgement has been sent.

5.3 The validity, construction, and performance of any agreement resulting from a booking shall be governed by English law. The parties irrevocably submit to the non-exclusive jurisdiction of the High Court of England and Wales.

6. STUDENT PRIVACY AND PUBLICITY

 

6.1 Lander School of Performing Arts may wish to share student experiences, achievements, or work (such as recordings, photos, or videos) on social media, the website, or other marketing materials.

6.2 No student will be publicly identified or have images/videos shared without explicit consent. Consent is requested separately via a dedicated consent form.

6.3 Students and parents/guardians may specify whether they consent to:

  • Sharing of the student’s voice/audio only

  • Sharing of the student’s images or video

  • Both of the above

6.4 If a student or parent/guardian does not wish any content featuring the student to be shared, they must notify Lander SOPA in writing via email before any lesson or recording takes place.

6.5 Consent can be revoked at any time by notifying Lander SOPA in writing, and any future sharing will cease immediately.

6.6 Lander SOPA will take reasonable steps to respect privacy requests but cannot guarantee removal of content already published prior to consent withdrawal.
